Contract for disposable nitrile gloves

The Administration of State Material Reserves of the Slovak Republic, as the contracting authority, hereby announces that it is again launching a direct negotiated procedure pursuant to Section 81(c) of Act No. 343/2015 Coll. on public procurement and on amendments to certain acts, as amended (the “Public Procurement Act”), for the award of the contract “Disposable nitrile gloves” under amended conditions compared with the contract “Disposable nitrile gloves cat. III”. The amended conditions and the need to run the procurement again arise from the fact that, following the previous notice and call, the contract was not awarded to any economic operator. The reason for not awarding the contract was that the economic operators submitted only such bids from which it follows that the goods do not meet the requirements laid down by the contracting authority.

For these reasons, the contracting authority has amended the conditions of this procedure so as to enable the maximum number of economic operators to submit bids and negotiate them, and at the same time so that the award procedure fulfils its purpose, i.e. enables the delivery of the required quantity of disposable nitrile gloves (the “gloves”). The amendment of the conditions concerns in particular the manner in which economic operators must demonstrate that the goods they offer meet the requirements of the contracting authority, so that this manner is simpler (among other things in view of the administrative and communication obstacles caused by the global COVID-19 pandemic).

The contract is awarded in connection with the need to carry out the nationwide testing of persons in the territory of the Slovak Republic announced by the Government of the Slovak Republic using “screening tests”, including for the first round of this testing, which will take place on 31 October and 1 November 2020. It follows that a considerable quantity of the required protective gloves will need to be supplied (in the order of millions of pieces). The contracting authority will therefore negotiate with relevant economic operators that express an interest, with the aim of concluding a contract and delivering the total required quantity of gloves, including as the sum of smaller contracts – separate deliveries from several suppliers.

In this connection, we invite all relevant economic operators able to supply goods according to the specification in the documents annexed to this notice to submit their bids without delay to the e-mail address reserves@reserves.gov.sk.

The contract is being awarded under extreme time pressure and, given the urgency of the need for the gloves, we ask operators to act within hours and to submit their bids as soon as possible.

In view of the immediate need to secure gloves for the first round of nationwide testing, which will take place on 31 October and 1 November 2020, the contracting authority will give priority to negotiating with operators that express an interest by 12:00 on 28 October 2020 and whose bids also include an offer to deliver immediately, i.e. by 30 October 2020 (assuming stock availability).

However, the contracting authority will also contact economic operators expressing an interest after that deadline, up to 08:00 on 3 November 2020, on a rolling basis as they submit their bids. The negotiated procedure will then continue on further dates and in further blocks according to the needs of the contracting authority, so that it can secure a sufficient quantity of gloves for subsequent rounds of nationwide testing and for any urgent needs of the Slovak Republic.
